Invitation to Treat: All Montblanc products, prices, and inventory information displayed in the Store constitute an invitation to treat only.
Formation of Contract: When you submit an order and complete payment, the automated confirmation email or message sent by the system merely signifies that we have received your order request. The sales contract between the buyer and the seller is formally concluded only when we officially hand the goods over to a premium logistics provider for shipment and update the tracking number in our system.
Quantity Restrictions: To prevent malicious stockpiling or unauthorized commercial resale, we reserve the right to limit the maximum purchase quantity per order or per account for specific rare or limited-edition Montblanc products.
2. Prices, Taxes, and Payment Methods
Price Changes: We reserve the right to change listed prices at any time due to fluctuations in international exchange rates or raw material costs (such as precious metals like gold and platinum, or premium leather). Prices for orders that have already been successfully concluded and are in the shipping process remain unaffected.
Payment Compliance: You may use our supported secure online payment methods or Cash on Delivery (COD) services (subject to the specific "Terms of Payment Methods"). You must ensure that the credit card, bank account, or payment instrument used belongs to you or that you have obtained legal authorization to use it.
3. Product Status and Special Declarations (for High-Value Items)
Manufacturer Serial Number Tracking: Every Montblanc product sold—such as writing instruments and fine watches—comes with a unique manufacturer serial number. Prior to packaging and shipment, we conduct continuous high-definition video monitoring and record the serial number to ensure authenticity traceability and to prevent malicious product swapping. Variations Due to Craftsmanship: Certain Montblanc products (such as those featuring natural cork, premium leather, or hand-polished nibs) may exhibit slight variations in texture or color resulting from natural materials or manual craftsmanship; these are not considered quality defects but rather unique hallmarks of luxury artistry.
4. Delivery, Ownership, and Transfer of Risk
Full Insurance and Signature Upon Receipt: We exclusively use premium, fully insured courier services for delivery (subject to the "Shipping and Delivery Policy"). We and the insurance provider bear the risk of damage or loss during transit.
Transfer of Risk and Ownership: The risk of damage or loss and the ownership of the goods transfer to you upon your formal acceptance of the package via handwritten or electronic signature (or that of your designated recipient).
5. Conditions and Restrictions for Returns and Exchanges
Strict Condition Standards: Given the nature of luxury goods, any item returned or exchanged must remain in absolutely new and unused condition.
Core Restriction on Writing Instruments: Any fountain pen that has been filled with ink or dipped for testing is deemed "used" and permanently forfeits eligibility for return or exchange.
Exclusion of Customized Items: Returns, exchanges, or order cancellations are not accepted for any Montblanc products featuring personalized embossing, laser engraving, or custom nibs, unless there is a significant manufacturing defect.
6. Fraud Prevention and Right to Cancel Orders
To maintain a secure trading environment, we reserve the right to unilaterally suspend shipment, request additional identity verification (such as real-name authentication), or cancel the order and issue a refund if we detect any of the following anomalies or fraud risks:
Alerts indicating potential unauthorized use or high-risk activity associated with the payment account.
Shipping addresses or phone numbers that are clearly fictitious, incorrect, or known to be associated with a high frequency of malicious delivery refusals.
Malicious orders generated through improper means, such as exploiting system vulnerabilities, hacking, using automated scripts for purchasing, or taking advantage of pricing errors.
7. Limitation of Liability
To the maximum extent permitted by applicable law, our total cumulative liability to you for any claims arising from the performance of these Terms of Sale (whether based on breach of contract or tort) shall in no event exceed the total amount actually paid by you to this store for the specific Montblanc product in question. We shall not be held liable for any indirect or commercial loss of profit.
8. Governing Law and Dispute Resolution
